1. Payment
The Coach will issue invoices for the Charges to The Client upon receipt of payment. The Client must pay the Charges in full to the Coach no later than 48hrs before services under this Agreement can be commenced;
(i) OR 48hrs before the 1st, 3rd and 5th sessions if a payment plan is agreed for Plant the Seed Package.
(ii) OR 48hrs before individual sessions if agreed in advance.
The Client must pay the Charges by bank transfer. If The Client does not pay any amount properly due to the Coach under this Agreement, the Coach may charge The Client interest on the overdue amount at the rate of 8% per annum above the Bank of England base rate from time to time (which interest will accrue daily until the date of actual payment and be compounded at the end of each calendar month). The session may be refused if payment has not been made as required by this Agreement.
2. The Coach’s Commitment
The Coach will provide video call Coaching sessions via Skype. This is a professional Client relationship designed to facilitate the creation and development of personal or professional goals and to develop and carry out a strategy / plan for moving towards those goals. Emails or Direct Messages are welcome in between sessions if the Client would like to share success, have an urgent question or issue. The Coach will respond where possible, on the same day Monday - Friday. For messages received after 6pm, a response cannot be guaranteed until the following working day.
3. The Client Commitment
The Client agrees to attend the call with the Coach at the specified times. The Client agrees to be honest and open, willing to believe in themself and adopt an enthusiastic and positive outlook on life from this moment onwards. The Client is truly committed to change and agrees to take responsibility for their life, choices and actions. The Client understand that results are not guaranteed and the effectiveness of the methods and training on achieving results are dependent on compliance and implementation by the Client. By entering into a coaching relationship, the Client acknowledges that they wish to effect change in their life, and will work with the Coach to develop and progress through objectives, barriers, actions, development and successes.
4. Coaching
The Client enters into this agreement with the full understanding that The Client is solely responsible for creating their own results. Coaching is not counselling, psychotherapy, psychoanalysis, or any other form of mental health care treatment or therapy, nor is it to be used as a substitute for professional advice by legal, medical, financial, business or other qualified professional. The Client understands that all decisions and actions in these areas are The Clients sole responsibility.
5. The Clients agenda
If the session is not heading in the direction the Client would like, if the Coach ever says anything the Client doesn’t feel comfortable with or if the Client has a concern with the way the sessions are proceeding, the Client will let the Coach know immediately.
6. License
The Coach hereby grants to the Client an exclusive and irrevocable license to use and store any Client Materials provided during the coaching period and thereafter. This license does not allow the Client to copy, distribute, adapt, edit or share the Client Materials with third parties.
7. Ethics and Confidentiality
The Coach is a member of the ICF (International Coach Federation) and follows the ICF Code of Ethics - https://coachingfederation.org/ethics/code-of-ethics. Any notes the Coach makes during the session about The Client will be kept confidential. All data stored will be filled in a securely stored in an area that only Blossom with Lisa has access to. The Coach will not use or disclose the information the Client shares with them during the sessions, except as authorised by the Client or required by law. The Client understands that on occasion the Coach may anonymously share generalised information for training purposes with Supervision. The Client’s identity and any information that could lead to the Client’s identification will remain entirely confidential.
8. Admin
Where it is necessary for either the Client or the Coach to reschedule the session, this will be done by Direct Message or call at least 48hrs before the scheduled session. The Client will be charged for missed sessions which are not rescheduled in accordance with this Agreement, except in exceptional circumstances (at the Coach’s discretion). If less than 48 hours’ notice is provided the Coach will attempt to find a different mutually convenient slot, but this cannot be guaranteed. If the Client is late for a session, the session will still complete 60 / 120 minutes (whichever duration has been agreed) from the scheduled start time.
9. Refunds
In accordance with Distance Selling Regulations, the Client has the right to cancel and obtain a full refund within 14 days of this Agreement being executed by both Parties. Refund requests should be made in writing to lisa@blossomwithlisa.com and a full refund will be provided within 10 working days from the date of the request.
In the event that one or more coaching sessions have already taken place within the first 14 days following execution of this contract, the Client is still entitled to request a refund but the value of the coaching session(s) shall be deducted from the amount paid by the Client, along with any reasonable costs which have been incurred by the Coach. The value of any sessions which have been provided (or deemed provided due to late cancellation), will be determined pro-rata and will include any preparatory time completed by the Coach.
There is no obligation on the Coach to refund any amounts paid where cancellation requests are made following the 14 day cancellation period. Should the Client wish to obtain a refund outside of the 14 day cancellation period they should set out their request in writing and send it to lisa@blossomwithlisa.com.
10. Termination
Either party may terminate this Agreement by giving to the other party at least 30 days' written notice of termination. Either party may terminate this Agreement immediately by giving written notice of termination to the other party if the other party commits a material breach of this Agreement as laid out below. Written notice must be sent lisa@blossomwithlisa.com.
Either party may terminate this Agreement immediately by giving written notice of termination to the other party if:
(a)The Coach
(i) is dissolved or unable to conduct all (or substantially all) of the business financially.
(ii) is unable to continue for health reasons or factors that will affect the quality of future sessions for the Client.
(iii) feels the Client has breached the Terms and Conditions of this contract.
(b) if either party:
(i) dies as a result of illness or incapacity.
(ii) is the subject of a bankruptcy petition or order.
(iii) receives information where a conflict of interest may arise.
Upon termination of this Agreement, the Coach shall immediately cease to be liable to the Client in respect of the Coaching sessions.
11. Liability
The Coach is reliant on the Client to provide open and honest disclosure of their circumstances. The Coach shall not be liable to the Client in respect of any situation. In the event of the Client feeling mental, physical or emotional distress (or related ailment or condition) which the Client believe to be related either directly or indirectly to the Coaching sessions, the Coach will not be liable for any loss, damage or cost incurred by the Client (or any person related to the Client) which may arise as a result of this Agreement. The Coach is fully insured and covered as required by UK Law.
